The Downside of Automated Customer Service: Air Canada Forced to Refund Misled Passenger

The passenger, Jake Moffatt, sought to book a flight under the bereavement rates after his grandmother’s death. However, the chatbot inaccurately advised him to book the flight immediately and then request a refund within 90 days. This misinformation led Moffatt to believe that he could receive a refund, despite Air Canada’s policy clearly stating otherwise.

Despite following the chatbot’s advice and requesting a refund, Moffatt faced rejection from Air Canada. The airline argued that the chatbot’s inaccurate response should not make them liable as the chatbot is considered a separate legal entity responsible for its actions. This defense is unprecedented, as no Canadian company had previously tried to disown the responsibility of information provided by a chatbot. However, Tribunal member Christopher Rivers ruled in favor of Moffatt, stating that Air Canada’s defense was baseless, and they should be held accountable for the misinformation provided by their chatbot.

Moffatt’s persistence led him to file a small claims complaint, which ultimately resulted in a ruling in his favor. The Tribunal ordered Air Canada to provide Moffatt with a partial refund of $650.88 CAD, along with additional damages to cover interest on the airfare and tribunal fees. Despite initially offering Moffatt a $200 coupon for a future flight, Air Canada accepted the Tribunal’s decision and closed the matter.

This incident sheds light on the potential pitfalls of relying solely on automated customer service systems such as chatbots. While these AI-powered tools can enhance efficiency and provide quick responses, they may not always offer accurate information. Customers should exercise caution when interacting with chatbots and verify critical information independently to avoid misunderstandings and potential financial loss.

Following the controversy, Air Canada’s chatbot support was noticeably missing from the airline’s website. It appears that Air Canada may have disabled the chatbot functionality in response to the incident. However, the airline declined to confirm whether the chatbot has been permanently removed from its online support offerings.
