The Consequences of Amazon’s Violations of Labor Law

Recent revelations have shed light on Amazon’s egregious violations of labor law and mistreatment of its employees. A National Labor Relations Board (NLRB) judge has ruled that the company, along with its consultants, interrogated and threatened workers regarding their union activities, racially disparaged organizers, and engaged in various other illegal actions. This article aims to explore the alarming details of Amazon’s labor law violations and the consequences it faces as a result.

Multiple Violations of Federal Labor Law

The NLRB judge, Lauren Esposito, found that Amazon committed multiple violations of federal labor law between May and October 2021 at its largest warehouse in New York, known as JFK8. During this period, there was a significant increase in organizing activity among employees. Esposito’s decision was based on extensive virtual hearings that lasted almost a year and involved testimonies from Amazon employees, managers, and labor consultants.

Confiscation of Organizing Materials and Surveillance

An alarming revelation from the hearings was that Amazon illegally confiscated organizing pamphlets from employees, which were being distributed in on-site breakrooms. This confiscation was a blatant attempt to impede union organizing efforts. Furthermore, the company engaged in surveillance of employees’ organizing activities, violating their rights to privacy and freedom of association.

Another damning finding was that Amazon retaliated against an employee at a neighboring facility, Daequan Smith, for supporting the union. Smith was sent home early from his shift and had his work assignments changed as a form of punishment. Such retaliation is a clear violation of labor laws and further demonstrates Amazon’s disregard for the rights of its workers.

Threats and Disparagement by “Union Avoidance” Consultants

Amazon’s engagement of a “union avoidance” consultant, Bradley Moss, also resulted in violations of labor laws. Moss, hired by the company to dissuade workers from unionizing, threatened employees by telling them it would be “futile” to join the Amazon Labor Union (ALU). This type of coercion is a reprehensible manipulation tactic used to undermine workers’ rights. Additionally, Moss disparaged organizers, referring to them as “thugs” and dismissively downplaying their efforts.

As a consequence of these labor law violations, Amazon now faces repercussions. It is required to post notices at its JFK8 and DYY6 facilities to remind workers of their rights. Furthermore, the company must compensate Daequan Smith for any loss of earnings and other benefits resulting from the retaliatory actions taken against him.

Criticism and Scrutiny of Amazon’s Labor Practices

To understand the extent of Amazon’s labor law violations, it is essential to recognize the broader context. The company faces a staggering 240 open or settled unfair labor practice charges across 26 states, indicating a pattern of disregard for workers’ rights. This scrutiny has intensified as the Covid-19 pandemic fueled increased union organizing efforts within Amazon’s warehouse and delivery workforce.

Chris Smalls, a former Amazon employee and one of the leaders of the Amazon Labor Union, has been at the forefront of the company’s labor disputes. A leaked memo revealed that Amazon’s general counsel referred to Smalls, a Black man, as “not smart or articulate” and recommended making him the face of efforts to organize workers. This blatant racism and the company’s attempt to delegitimize Smalls’ role further exemplify the toxic work environment at Amazon.

Despite the labor union victory at JFK8, Amazon continues to challenge the election results, as well as the conduct of both the NLRB and the union. The agency, however, upheld the results in January, indicating the validity of the employees’ decision to unionize. These ongoing challenges and disputes reflect Amazon’s unwillingness to accept the demands and rights of its workers.

The NLRB judge’s ruling against Amazon and its labor law violations is a wake-up call for the company and the wider labor movement. It exposes the mistreatment, intimidation, and disregard for workers’ rights that Amazon has perpetuated. The consequences faced by Amazon, although a step toward accountability, must be accompanied by comprehensive reforms to ensure fair treatment, union rights, and improved labor conditions for all Amazon employees.
