The Allegations Against Activision Blizzard: Age Discrimination and Whistleblower Violations

An unnamed former Activision executive has initiated legal action against the renowned gaming company, accusing them of age discrimination and violating California’s whistleblower protection law. This former executive, who is 57 years old and had been with the company since 2014, claims that he and six other colleagues, all aged 47 or older, were dismissed from a 200-member team as part of a larger restructuring effort by Activision Blizzard in August last year.

This lawsuit, as reported by law360, not only highlights the alleged discriminatory actions but also brings forth alarming statements attributed to recently-departed Activision Blizzard CEO Bobby Kotick. The executive claims that Kotick made remarks insinuating that there were “too many old white guys” within the company, resulting in two white executives leaving shortly after these ageist comments. Interestingly, one of these departing executives even recommended the plaintiff as a replacement, but Activision Blizzard chose to promote a younger non-white employee instead, who eventually became the plaintiff’s manager.

The plaintiff further alleges that the said manager criticized his work performance in a way that led to the lowest merit-based salary increase he had received during his tenure at the company. Additionally, the lawsuit claims that a female colleague in the plaintiff’s department made false and defamatory remarks about him to human resources and his manager, while simultaneously expressing dissatisfaction with her own merit-based salary increase.

In response to the discriminatory and defamatory accusations against him, the plaintiff filed a complaint with the company’s Human Resources department. Regrettably, this complaint was ignored, leaving him feeling unprotected and exposing Activision Blizzard’s potential lack of “checks and balances.” Consequently, the plaintiff seeks compensation for various damages, including loss of earnings, negative effects on career advancement, damage to reputation, emotional distress, wrongful termination, and legal costs.

While these allegations present a troubling situation, it is essential to critically examine the circumstances surrounding them. Looking at Activision Blizzard’s most recent Diversity, Equity, and Inclusion Look-Back report, we can see that as of 2022, 73% of their workforce consisted of males, and 61% of their US workforce was white. These statistics challenge the notion that white men are endangered or disadvantaged within the company. If there is an ongoing campaign against white men at Activision Blizzard, it appears to be silently executed.

However, it is worth considering the validity of the accusations related to age discrimination. Ageism is a complex issue that permeates various industries, including the gaming sector. A CompTIA survey conducted in 2023 revealed that only 17% of tech workers and 14% of software developers and engineers in the United States were over the age of 55. This data sheds light on the persistent bias toward younger hires within these fields. In fact, Kate Edwards, a prominent figure in the videogame industry, launched the “50 over 50” initiative in 2019 to address this industry-wide bias.

Surprisingly, Activision Blizzard has chosen not to comment extensively on the ageism lawsuit. When approached by GamesIndustry.biz, they merely referred to their equal employment opportunity policy. It is worth noting, however, that the company recently settled another lawsuit brought against them by the State of California. This lawsuit accused Activision Blizzard of promoting a “frat boy” culture characterized by sexual harassment, discrimination, and unequal pay.

The allegations against Activision Blizzard raise concerns about the company’s commitment to fair employment practices. As the gaming industry continues to grapple with issues of diversity and inclusion, it is imperative for organizations to cultivate a work environment that values employees of all backgrounds, ages, and identities. Only by addressing these systemic issues and ensuring equal opportunities for all can the gaming industry thrive and truly reflect the diverse communities it serves.
